Terms of Service
Welcome to Influgent. These Terms of Service ("Terms") govern your use of the Influgent mobile application and related services (collectively, the "Service") operated by Influgent, Inc., a Delaware corporation with its principal place of business at 2261 Market Street STE 13880, San Francisco, CA 94114 ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Influgent, you confirm that you are at least 18 years old and agree to be bound by these Terms. If you do not agree, you must not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.
2. Account Registration
To use Influgent, you must create an account using a valid email address or a supported social login provider (Google or Apple). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use.
3. Instagram Integration
Influgent allows you to connect your Instagram professional account via OAuth. By connecting your account, you authorize us to access your Instagram profile information, media, and insights data through the Instagram API. You may disconnect your Instagram account at any time from the app settings. Our use of Instagram data is subject to Meta's Platform Terms and Instagram's API Terms of Use.
4. AI-Powered Features
Influgent provides AI-powered chat assistance and automated task execution. AI-generated content, suggestions, and analysis are provided for informational purposes only and should not be relied upon as professional advice. We do not guarantee the accuracy, completeness, or suitability of AI-generated outputs. You are solely responsible for reviewing and acting on any AI suggestions.
5. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) interfere with or disrupt the Service; (d) use the Service to spam, harass, or harm others; (e) reverse engineer or attempt to extract source code; (f) violate Instagram's or any third-party platform's terms of service through your use of Influgent.
6. Subscription and Payments
Certain features of Influgent may require a paid subscription. Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective terms. You may cancel your subscription at any time through your device's subscription settings. Refunds are handled according to the policies of the applicable app store.
7. Fair Use Policy
Features described as "unlimited" in our subscription plans are subject to a fair use policy. "Unlimited" means a generous allowance designed for normal, individual use and does not permit abuse, automated bulk operations, or usage that places unreasonable load on our systems. We reserve the right to throttle or restrict access if usage significantly exceeds what is reasonably expected for a single user. We will notify you before taking any action and work with you to find a resolution.
8. Intellectual Property
The Service, including its design, features, and content (excluding user-generated content), is owned by Influgent and protected by intellectual property laws. You retain ownership of your content but grant us a limited license to process it as necessary to provide the Service.
9. Account Termination
You may delete your account at any time from the Settings page. Upon deletion, we will remove your personal data, Instagram data, media files, and preferences from our systems. We reserve the right to suspend or terminate accounts that violate these Terms.
10. Limitation of Liability
To the maximum extent permitted by law, Influgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any actions taken based on AI-generated content or automation results.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in San Francisco, California, or in the state or federal courts located in San Francisco County, California.
